NTT DoCoMo Agrees to a Temporary Waiver of its Consultation Rights under its
Investor Agreement with AT&T Wireless Services
TOKYO, JAPAN, January 27, 2004 NTT DoCoMo, Inc. (DoCoMo) has agreed with AT&T Wireless Services, Inc. (AT&T Wireless) to a temporary and limited waiver of DoCoMos right under its Investor Agreement with AT&T Wireless to be notified of and receive information regarding any proposed transaction pursuant to which DoCoMos interest in AT&T Wireless would be affected.
The agreement was made pursuant to a request from AT&T Wireless in connection with the decision of its board of directors to implement a process to solicit proposals regarding the acquisition of AT&T Wireless. In the agreement, AT&T Wireless has confirmed that DoCoMo may submit an acquisition proposal to AT&T Wireless pursuant to that process should it decide to do so.
DoCoMo entered into the agreement in order to preserve a broad set of options and has not made any decision to make any proposal to AT&T Wireless at this time.
