Oakland County Motor Vehicle Offenses Lawyer Paul Tafelski Explains When Traffic Violations Become a Misdemeanor

Oakland County motor vehicle offenses lawyer Paul J. Tafelski releases a new article (https://www.michigandefenselaw.com/blog/when-does-a-traffic-violation-become-a-misdemeanor/) explaining when a traffic violation becomes a misdemeanor. The lawyer mentions that there are a lot of things that can be considered misdemeanors. However, the court has the authority and the discretion to be able to put someone in jail for something that they did. One of the reasons why a person may face a misdemeanor charge is when they drive with their license suspended.

“With an offense like driving with a suspended license, if you are convicted you will receive an additional thirty-day suspension on your license, and two points off your license. You might face probation, and be subjected to drug or alcohol testing if the court feels that is appropriate. You could go to jail for up to ninety-three days for a first offense and up to one year in jail for a second subsequent offense,” the Oakland County motor vehicle offenses lawyer says.

The lawyer explains that most people think that driving with a suspended license is not serious. However, in many courts, this offense is taken very seriously, especially if the person is a repeat offender. Many people find themselves surprised that they would need to be in jail for this offense but courts in Michigan are very strict with this offense.

Attorney Paul Tafelski adds that if someone is convicted of driving with a suspended license, they may receive six points on their license and a 90-day hard suspension. This suspension means that they will not be able to drive at all for 90 days.

In the article, attorney Tafelski adds, “Surprisingly most people think of reckless driving as being totally out of control, but the statute basically says that a person is guilty of reckless driving if they drove in a reckless manner. It is really vague, and not as dramatic as many people think. There have been many examples of people getting ticketed for reckless driving simply because they were spinning their tires on a road or doing donuts in a snow-covered parking lot when there were no other cars around.”

Lastly, attorney Paul Tafelski emphasizes the importance of having a skilled lawyer when facing charges of driving with a suspended license. Having an experienced attorney may be able to help the defendant understand their rights and protect their freedom.
