By: PRLog

ATLANTA - April 21, 2023 - PRLog -- Entertainment Attorney James L. Walker Jr. announced the news of the favorable resolution of a significant copyright infringement lawsuit. The settlement was achieved on behalf of clients Mervyn Warren, Omerror Dawson, and the Take 6 group members. The lawsuit had been filed against H.E.R., the artist, and the co-writers of her chart-topping song "Could've Been."

"With over two million copies sold, "Could've Been" has graced two of H.E.R.'s albums and received multiple award nominations. The case involved several defendants, among them being Dernst Emile II, Hue Wayne Strothers, Gabriella "H.E.R." Sarmiento, David A. Harris, Sony Sounds (a branch of Sony Music Publishing (US) LLC), Sony Music Entertainment, EMI April Music Publishing ("Her Publishing"), Next Up Music Group, Tailored 4U Music, Universal Music Corporation ("UMG"), and WC Music Corp.

After conducting a thorough analysis of the two songs, Take 6 identified similarities between them. As a result, the group took legal action.

The lawsuit alleged that H.E.R. and her co-writers had infringed on the copyright of the song "Come Unto Me", which was co-written and published by Warren and Dawson, and performed by Take 6. The lawsuit claimed that H.E.R. and her team had used substantial portions of "Come Unto Me" without obtaining proper clearance or permission, leading to copyright infringement.

After months of intense litigation, the parties involved have reached a settlement, terms of which are confidential. The Take 6 members, Warren, and Dawson have expressed their gratitude to Attorney James L. Walker Jr. for his tireless work and unwavering commitment to protecting their intellectual property rights. Walker & Associates is renowned for its expertise in handling complex copyright infringement cases and providing exceptional legal representation to its clients.

"This is a significant victory for our clients and for the protection of intellectual property rights," said James L. Walker Jr. "We are pleased to have successfully resolved this issue and are grateful for the trust our clients have placed in our legal team."

The successful resolution of this case sends a clear message to all artists and music industry leaders that copyright infringement will not be tolerated, and proper clearance and permission must be obtained before incorporating someone else's work into a new piece.

Ed Keane, longtime manager of the R&B, jazz and gospel sextet, said, "Take 6 and I are pleased that we have been able to resolve this case and have no further comment. I would like to thank James L. Walker, Jr., his firm Walker & Associates, and the staff and team of lawyers, for their most capable and diligent work on this case. The group can now return to the studio and continue to record their next album which will be their unique renditions of transcendent jazz tunes.".
