In a news
release on November 3, 2009, Swift Energy Company announced preliminary
unaudited financial results for the third quarter of 2009, provided updated 2009
guidance and reported that certain of its officers will discuss such financial
results in a conference call to be held at 9 a.m. (CST) on that
date. As provided in General Instruction B.2 to Form 8-K, the
information furnished in this Item 2.02 and in Exhibit 99.1 hereto shall
not be deemed “filed” for purposes of Section 18 of the Securities and
